According to California Civil Code section 3342a, dog owners are to be held legally responsible if their dog bites or attacks a person.  The law states,

“The owner of any dog is liable for damages suffered by any person who is bitten by the dog while in a public place or lawfully in a private place, including the property of the owner of the dog, regardless of the former viciousness of the dog or the owner’s knowledge of such viciousness.”

Under the terms of the law, it’s the responsibility of the owner to restrain the dog and keep it from biting a person.   In the event that a dog bites or injuries a person, the owner will be held responsible for the incident and liable for paying damages to the victim.  Even if the dog never bit a person or displayed signs of aggression before, the owner will still be held liable for the attack.  The only time an owner will not be held accountable for a dog bite injury is if the victim was trespassing or committing a crime on the owner’s property.
